Criminal Court Cases in Gates County
Gates County uses one Clerk of Superior Court for both trial levels. Superior Court tries felonies. District Court hears misdemeanors, infractions, and the first stages of felony cases. Both court records run through the clerk at 202 Court Street in Gatesville. The office is open weekdays from 8:30 a.m. to 5:00 p.m. and answers at 252-357-1365. Gates County joined eCourts in Track 3 on February 5, 2024. The public Portal is free, view-only, mobile-capable, and available without an account for ordinary public data. Smart Search starts with one “Record Number or Name” field. It accepts a party, case number, citation, business, attorney name or bar number, cross-reference number, or nickname. Add the Gates County location, criminal case type, filing dates, or status after entering that first criterion.
A broad search can stop at 200 results. Narrow common names by location, date, date of birth when offered, or case type. A wildcard can broaden the basic name search, but the Judicial Branch warns that Party Name in the advanced filter can limit results and does not support that wildcard. Public images download one at a time. Error 141011 means an oversized document needs help from the clerk.

Read each charge separately. One count may be dismissed while another ends in a guilty plea. “Dismissed” means the prosecution ended that charge without a conviction. “Not guilty” is an acquittal after adjudication. “Guilty” is a conviction after plea or trial. Prayer for judgment continued and conditional discharge have special legal effects that should not be reduced to a simple guilty-or-dismissed label.

Criminal Case Stages in Gates County

Access Rules for Case Records
North Carolina generally opens clerk records to inspection under G.S. 7A-109, subject to other laws and court rules. The broader North Carolina Public Records Law defines records made or received in public business. Neither rule makes every detail public. Why Gates County Charges Change
The arrest charge is an officer’s custody-stage label. The court case reflects the allegation the prosecutor files and pursues. The District 1 prosecutor may dismiss or amend a count, choose a different charge after review, or present a felony to the grand jury. A grand jury may return a true bill or decline an indictment. Plea terms and trial results can further change which counts reach judgment.
For that reason, a Gates County booking entry cannot establish a conviction. Compare it with the court disposition. If the file says dismissed, the charge did not result in a conviction. If it says not guilty, the court reached an acquittal. If a case does not appear, ask whether it is too new, archived, not yet digitized, confidential, sealed, or expunged.
